Proven Phone Terms of Service

1. Acceptance of Terms
1.1. Proven Phone reserves the right to modify these Terms at any time without prior notice. Updates will be effective upon posting to our website or kiosks. Your continued use of the Services constitutes acceptance of the updated Terms.
1.2. If you do not agree to these Terms, your sole remedy is to cease using the Services.
2. Proven Phone Marketplace
2.1. The Proven Phone kiosk platform operates as a marketplace, connecting buyers with verified sellers of used phones.
2.2. Proven Phone facilitates the transaction process but is not directly involved in the transfer of ownership between buyers and sellers.
2.3. Proven Phone does not guarantee the quality, safety, legality, or performance of listed items but ensures sellers meet verification requirements.
3. Eligibility
3.1. You must be at least 18 years old to use the Services. If under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to these Terms.
3.2. By using the Services, you confirm that all provided registration and payment information is accurate and truthful.
4. User Responsibilities
4.1. Account Security: You are responsible for maintaining the confidentiality of your account details and for all activities under your account. Notify Proven Phone immediately of unauthorized account use.
4.2. Compliance with Laws: You agree to comply with all applicable local, state, and federal laws regarding your use of the Services.
4.3. Prohibited Activities: You may not use the Services to:
- Sell stolen, counterfeit, or illegal items.
- Tamper with kiosks or software.
- Engage in fraudulent or deceptive practices.
5. Product Listings and Transactions
5.1. Listings: All devices listed on the Proven Phone platform must comply with our standards for quality, legality, and functionality.
5.2. Accuracy: Sellers are responsible for ensuring the accuracy of product descriptions, pricing, and condition. Proven Phone reserves the right to remove any listings that violate policies.
5.3. Sales are Binding: Once a buyer purchases a phone, the sale is binding unless Proven Phone policies regarding returns or disputes apply.
6. “Try Before You Buy” Feature
6.1. Buyers may use the “Try Before You Buy” feature to test phones for up to 5 minutes.
6.2. A temporary hold will be placed on the buyer’s credit card during the trial period.
6.3. The transaction will be completed if:
- The buyer does not return the phone within 5 minutes.
- The phone is returned in a damaged or altered condition.
7. Data Privacy
7.1. Proven Phone collects limited personal information (e.g., phone numbers) required for transactions.
7.2. Payment information is processed securely through third-party providers and is not stored by Proven Phone.
7.3. Proven Phone does not sell or share user data with unauthorized third parties.
8. Disputes and Refunds
8.1. Proven Phone may assist in resolving disputes between buyers and sellers at its sole discretion.
8.2. Refunds are issued only when required by law or Proven Phone policy.
9. Limitation of Liability
9.1. Proven Phone provides the Services “as is” and makes no guarantees regarding availability, accuracy, or performance.
9.2. Proven Phone is not liable for any indirect, incidental, or consequential damages arising from the use of its Services.
9.3. Proven Phone’s total liability is limited to the amount you paid for the Service within the 12 months preceding the claim.
10. Termination
10.1. Proven Phone may suspend or terminate access to the Services at any time, without notice, for violations of these Terms or misuse of the platform.
